Welcome to Swanirman Academy (hereinafter referred to as "the Academy," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Student," "you," or "your") and Swanirman Academy, governing your access to and use of our website, mobile applications, online learning platform, courses, educational materials, and all related services (collectively, the "Services").

By accessing, browsing, registering for an account, enrolling in any course, or otherwise using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue use of our Services.

These Terms, together with our Privacy Policy, Refund Policy, and any additional guidelines or rules posted on our platform, constitute the entire agreement between you and Swanirman Academy. In the event of any conflict between these Terms and any other policy, these Terms shall prevail unless explicitly stated otherwise.

Swanirman Academy reserves the right to update, modify, or replace any part of these Terms at its sole discretion. The most current version will always be available on this page with the updated effective date. Material changes will be communicated via email notification or prominent notice on our platform.

For the purpose of these Terms and Conditions, the following definitions shall apply throughout this document:

To create an account and use our Services, you must meet the following eligibility criteria:

• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher. Individuals between 13 and 17 years of age may use our Services only with the verified consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf.
• You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction of residence.
• You must not have been previously suspended, removed, or banned from using our Services.
• You must provide accurate, current, and complete information during the registration process and maintain the accuracy of such information throughout the duration of your account.

When you create an account with Swanirman Academy, you agree to the following obligations:

• You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username and password. You must not share, disclose, or transfer your login credentials to any third party.
• You are fully responsible for all activities that occur under your account, whether or not you have authorized such activities. This includes any purchases, course enrollments, content submissions, or communications made through your account.
• You must immediately notify Swanirman Academy of any unauthorized access to or use of your account, or any other security breach, by contacting our support team.
• Each account is for individual use only. You may not create or use multiple accounts for the purpose of circumventing restrictions, exploiting promotions, or any other unauthorized purpose.
• You agree to use a strong, unique password for your Swanirman Academy account and to update it regularly.

You agree to provide truthful, accurate, and up-to-date information during registration and throughout your use of our Services. This includes, but is not limited to, your full legal name, valid email address, phone number, and any other information required for course enrollment, payment processing, or certificate issuance. Providing false or misleading information may result in immediate account termination and forfeiture of any purchased courses or earned certificates.

Swanirman Academy offers a diverse range of educational programs, including but not limited to individual courses, bundled course packages, learning paths, bootcamps, live workshops, and subscription-based access models. The following terms govern your enrollment and access:

• Course Availability: All courses and programs are subject to availability. Swanirman Academy reserves the right to modify, update, discontinue, or remove any course or program at any time without prior notice. We will make reasonable efforts to notify enrolled students of significant changes.
• Access Duration: Unless otherwise specified at the time of purchase, access to individual paid courses is granted for a period as stated on the course enrollment page. Lifetime access, where offered, is defined as access for the commercially reasonable life of the course on our platform.
• Subscription Access: Subscription-based plans provide access to designated content for the duration of the active subscription period. Access to course materials will be revoked upon subscription expiration or cancellation, except for any courses for which separate lifetime access has been purchased.
• Live Sessions: Live workshops, webinars, and mentorship sessions are scheduled at specific dates and times. Swanirman Academy is not obligated to reschedule missed live sessions due to the student's absence, though recordings may be provided at our discretion.
• Prerequisites: Some courses may have prerequisites. It is your responsibility to ensure you meet all prerequisite requirements before enrolling. Swanirman Academy is not responsible for your inability to comprehend course material due to insufficient prerequisite knowledge.

Your access to enrolled courses is personal and non-transferable. You may not share, sell, sublicense, or otherwise distribute your course access to any third party. Swanirman Academy employs technical measures to detect and prevent unauthorized sharing, including but not limited to simultaneous login detection, IP monitoring, and device fingerprinting. Violation of these access restrictions may result in immediate account termination without refund.

• All prices displayed on the Swanirman Academy platform are in Indian Rupees (INR) unless otherwise specified. For international users, prices may be displayed in their local currency based on their geographic location.
• Prices are inclusive or exclusive of applicable taxes (GST, VAT, or other local taxes) as indicated at the time of checkout. You are responsible for any additional taxes, duties, or fees imposed by your jurisdiction.
• Swanirman Academy reserves the right to modify pricing for any course, subscription, or service at any time. Price changes will not affect courses or subscriptions already purchased at the previous price, unless otherwise stated.
• Promotional offers, discounts, and coupon codes are subject to specific terms and conditions, expiration dates, and usage limits. They cannot be combined unless explicitly permitted and have no cash value.

Swanirman Academy accepts payments through various methods including, but not limited to:

• Credit and Debit Cards (Visa, MasterCard, American Express, RuPay)
• Net Banking
• UPI (Unified Payments Interface)
• Digital Wallets (Paytm, PhonePe, Google Pay, and others)
• EMI (Equated Monthly Installments) through supported banking partners
• International payment methods as available through our payment gateway

All payment transactions are processed through secure, PCI-DSS compliant third-party payment gateways. Swanirman Academy does not directly store your complete credit card or debit card information on our servers.

If you purchase a subscription plan, your subscription will automatically renew at the end of each billing cycle (monthly, quarterly, or annually) at the then-current subscription rate, unless you cancel your subscription before the renewal date. You will receive a reminder notification at least 7 days before the renewal date. You may cancel auto-renewal at any time through your account settings or by contacting our support team.

No Refund Policy Due to the nature of digital products and instant access to course materials

Swanirman Academy does not offer any refunds under any circumstances. Once a purchase is completed and access is granted, it is considered final and non-refundable.

All content, materials, and intellectual property available on the Swanirman Academy platform are protected by copyright, trademark, trade secret, and other intellectual property laws. Understanding and respecting these rights is a fundamental condition of using our Services.

Swanirman Academy and its licensors retain all right, title, and interest in and to the Platform and all Content, including but not limited to:

• Course videos, audio recordings, and multimedia presentations
• Written materials, including course notes, articles, blog posts, and ebooks
• Quizzes, assignments, projects, and assessment materials
• Code samples, templates, frameworks, and software tools
• Graphics, logos, icons, images, and visual designs
• The Platform's user interface, design, and underlying source code
• Trademarks, service marks, and trade names, including "Swanirman Academy" and associated logos
• Proprietary teaching methodologies, curricula, and course structures

Upon enrollment in a course, Swanirman Academy grants you a limited, non-exclusive, non-transferable, revocable license to access and view the course content solely for your personal, non-commercial educational purposes. This license does not grant you any ownership rights in the content and is subject to the restrictions outlined in Section 9 (Content Usage & Restrictions).

As a user of Swanirman Academy, you agree to conduct yourself in a manner that is respectful, ethical, and in compliance with all applicable laws. You acknowledge that your use of our Services is subject to the following conduct guidelines:

• Use our Services solely for lawful, personal educational purposes.
• Respect the intellectual property rights of Swanirman Academy, its instructors, and fellow students.
• Engage in course discussions, forums, and community spaces in a respectful, constructive, and professional manner.
• Complete assignments, quizzes, and assessments honestly and without resorting to plagiarism, cheating, or academic dishonesty of any kind.
• Keep your account credentials secure and not share them with others.
• Report any bugs, vulnerabilities, or issues you discover on our platform to our support team rather than exploiting them.

You expressly agree NOT to engage in any of the following activities:

• Content Piracy: Copying, recording, downloading (beyond authorized downloads), screen-capturing, or distributing any course content through any medium or platform.
• Account Sharing: Sharing your account access with others, allowing simultaneous logins, or selling/transferring your account to any third party.
• Harassment & Abuse: Harassing, bullying, threatening, defaming, or intimidating any other user, instructor, or staff member of Swanirman Academy.
• Spam & Solicitation: Posting unsolicited promotional content, advertisements, or spam in course discussions, forums, or community spaces.
• Impersonation: Impersonating any person, entity, or Swanirman Academy representative, or falsely claiming affiliation with any person or entity.
• Hacking & Exploitation: Attempting to gain unauthorized access to our systems, servers, networks, or other users' accounts through hacking, phishing, social engineering, or any other means.
• Data Scraping: Using automated tools, bots, crawlers, or scrapers to extract data, content, or user information from our platform.
• Reverse Engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code of our platform or any related technology.
• Fraudulent Activity: Engaging in any form of payment fraud, identity theft, or abuse of our refund policy.
• Harmful Content: Uploading, posting, or transmitting any content that contains viruses, malware, trojans, or any other harmful code.

The content provided through Swanirman Academy courses and materials is licensed, not sold, to you. Your use of this content is subject to the following restrictions:

• Viewing and streaming course content through the Swanirman Academy platform for personal learning.
• Downloading course materials specifically marked as downloadable (e.g., worksheets, templates, resource files) for personal use.
• Taking personal notes based on course content for your own reference.
• Applying knowledge and skills gained from courses to your personal projects and professional work.

• Reproducing, duplicating, or copying course content in any format (digital or physical) for distribution to third parties.
• Uploading, sharing, or posting course content on any third-party platform, website, social media, file-sharing service, or torrent site.
• Using course content to create competing educational products, courses, or training materials.
• Reselling, sublicensing, or commercially exploiting any course content or materials.
• Removing, altering, or obscuring any copyright notices, watermarks, or proprietary markings from course materials.
• Using course content for any AI/ML model training purposes without explicit written authorization from Swanirman Academy.

When you submit, post, or share content on our platform (including forum posts, reviews, assignment submissions, project showcases, and comments), you grant Swanirman Academy a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, display, and distribute such content in connection with our Services. You represent and warrant that you own or have the necessary rights to the content you submit, and that such content does not infringe upon the intellectual property rights of any third party.

Swanirman Academy may issue certificates of completion, achievement, or participation for certain courses and programs. The following terms govern the issuance and use of such certificates:

• Eligibility: Certificates are issued only upon successful completion of all required course components, including video lectures, assignments, quizzes, and assessments, as determined by the course criteria. Minimum passing scores and completion requirements vary by course and are specified on each course page.
• Nature of Certificates: Certificates issued by Swanirman Academy are certificates of completion or achievement and represent that you have successfully completed the specified course curriculum. Unless explicitly stated otherwise, they are not equivalent to academic degrees, professional licenses, or government-recognized certifications.
• Verification: Each certificate includes a unique verification ID that can be used by third parties to verify its authenticity through our platform.
• Revocation: Swanirman Academy reserves the right to revoke any certificate if it is determined that the student obtained it through fraudulent means, academic dishonesty, or violation of these Terms.
• Display & Sharing: You may display and share your earned certificates on your resume, portfolio, LinkedIn profile, and other professional platforms. However, you may not alter, modify, or misrepresent the certificate or the credentials it confers.

Your privacy is important to us. Swanirman Academy is committed to protecting the personal information of all users in compliance with applicable data protection laws, including the Information Technology Act, 2000, and its associated rules, as well as the Digital Personal Data Protection Act, 2023 (as applicable).

• Data Collection: We collect personal information necessary to provide our Services, including your name, email address, phone number, payment information, course progress data, device information, and usage analytics. The full scope of data collection is detailed in our separate Privacy Policy.
• Data Usage: Your personal data is used to provide and improve our Services, process transactions, send communications, personalize your learning experience, and comply with legal obligations.
• Data Sharing: We do not sell your personal information to third parties. We may share data with trusted service providers (payment processors, hosting providers, analytics services) who assist us in operating our platform, subject to strict confidentiality agreements.
• Data Security: We implement industry-standard security measures, including encryption (SSL/TLS), secure data storage, access controls, and regular security audits to protect your personal information.
• Your Rights: You have the right to access, correct, update, or request deletion of your personal information. You may exercise these rights by contacting us at the email address provided in the Contact section.
• Cookies: Our platform uses cookies and similar tracking technologies to enhance your experience, analyze usage patterns, and serve personalized content. You can manage your cookie preferences through your browser settings.

Our Platform may contain links to third-party websites, services, or resources, and may integrate with third-party tools and services to enhance your learning experience. These include, but are not limited to, payment gateways, cloud hosting services, video streaming platforms, code editors, and communication tools.

• Swanirman Academy is not responsible for the content, privacy practices, or policies of any third-party websites or services linked to or integrated with our Platform.
• Your interactions with third-party services are governed by those services' own terms and conditions and privacy policies. We encourage you to review the terms of any third-party service before using it.
• The inclusion of any third-party link or integration does not imply endorsement, sponsorship, or recommendation by Swanirman Academy.
• Swanirman Academy shall not be liable for any loss, damage, or harm resulting from your use of or reliance on any third-party services.

To the fullest extent permitted by applicable law:

• The Services and all Content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
• Swanirman Academy does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• Swanirman Academy does not guarantee the accuracy, completeness, reliability, or currency of any Content or information available on the Platform. Course content is for educational purposes and should not be construed as professional advice (legal, financial, medical, or otherwise).
• Swanirman Academy does not guarantee any specific learning outcomes, skill acquisition, employment opportunities, or career advancement as a result of using our Services.

To the maximum extent permitted by applicable law:

• In no event shall Swanirman Academy, its directors, officers, employees, agents, instructors, partners, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use our Services.
• Swanirman Academy's total aggregate liability to you for any and all claims arising from or related to these Terms or your use of our Services shall not exceed the total amount paid by you to Swanirman Academy during the twelve (12) months immediately preceding the event giving rise to the claim.
• The limitations of liability set forth in this section shall apply regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if Swanirman Academy has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Swanirman Academy, its directors, officers, employees, agents, instructors, partners, licensors, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or in connection with:

• Your use of or access to the Services;
• Your violation of any provision of these Terms;
• Your violation of any applicable law, regulation, or third-party rights (including intellectual property rights and privacy rights);
• Any content you submit, post, or transmit through our Platform;
• Any dispute between you and any other user of the Platform;
• Your negligence, willful misconduct, or fraud.

This indemnification obligation shall survive the termination of your account and these Terms. Swanirman Academy reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you shall cooperate fully with Swanirman Academy in asserting any available defenses.

You may terminate your account at any time by contacting our support team or through the account settings on our Platform. Upon termination:

• Your access to all enrolled courses and content will be immediately revoked.
• Any unused subscription period will not be refunded unless required by applicable law.
• Any earned certificates will remain verifiable, but you will lose access to download new copies.
• Your personal data will be handled in accordance with our Privacy Policy and applicable data retention laws.

Swanirman Academy reserves the right to suspend, restrict, or terminate your account and access to our Services, with or without notice, for any of the following reasons:

• Violation of any provision of these Terms and Conditions.
• Engaging in any prohibited activities as outlined in Section 8.
• Fraudulent, abusive, or suspicious activity detected on your account.
• Non-payment of fees or subscription charges.
• Extended period of account inactivity (exceeding 24 months).
• Request by law enforcement or other government authorities.
• Discontinuation or material modification of our Services (in whole or in part).
• Unexpected technical or security issues.
• Any other reason that Swanirman Academy deems necessary to protect the integrity of its Platform, Services, or user community.

These Terms and Conditions, and any disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of our Services, the parties agree to follow this dispute resolution process:

• Step 1 — Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting Swanirman Academy's support team. We will make good faith efforts to resolve the dispute within 30 days of receiving your written complaint.
• Step 2 — Mediation: If the dispute cannot be resolved informally, either party may initiate mediation through a mutually agreed-upon mediator. The costs of mediation shall be shared equally between the parties.
• Step 3 — Arbitration: If mediation is unsuccessful, the dispute shall be resolved by binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be in India. The language of arbitration shall be English.

Subject to the arbitration clause above, the courts located in India shall have exclusive jurisdiction over any disputes that are not subject to arbitration or that require interim or injunctive relief.

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Swanirman Academy.

Swanirman Academy shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to:

• Natural disasters (earthquakes, floods, hurricanes, volcanic eruptions)
• Epidemics, pandemics, or public health emergencies
• War, terrorism, civil unrest, or armed conflict
• Government actions, sanctions, embargoes, or regulatory changes
• Strikes, labor disputes, or industrial actions
• Power outages, internet service disruptions, or telecommunications failures
• Cyberattacks, including DDoS attacks, hacking, or ransomware
• Failure of third-party service providers or hosting infrastructure
• Any other event or circumstance beyond Swanirman Academy's reasonable control

In the event of a force majeure occurrence, Swanirman Academy will make reasonable efforts to resume normal operations as soon as practicable and will notify affected users of any material disruptions to Services.

Swanirman Academy reserves the right to modify, amend, or update these Terms and Conditions at any time, at its sole discretion. When we make changes:

• Minor Changes: For non-material changes (e.g., formatting, clarifications, corrections), we will update the "Last Updated" date at the top of this page. Continued use of our Services after such changes constitutes your acceptance of the updated Terms.
• Material Changes: For significant changes that affect your rights or obligations, we will provide reasonable advance notice through one or more of the following methods: email notification to your registered email address, prominent notice on our Platform, in-app notification, or a pop-up notification upon your next login.
• Effective Date: Material changes will take effect no sooner than 30 days after the notification is sent, unless the change is required by law or relates to the addition of new Services or features.

If you do not agree to the modified Terms, you must discontinue your use of our Services and may request account termination. Your continued use of our Services after the effective date of any modifications constitutes your binding acceptance of the updated Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties, or if such modification is not possible, it shall be deemed severed from these Terms.

The failure of Swanirman Academy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if made in writing and signed by an authorized representative of Swanirman Academy. A waiver of any right or provision on one occasion shall not be deemed a waiver of such right or provision on any subsequent occasion.

These Terms, together with our Privacy Policy, Refund Policy, and any other policies or guidelines referenced herein, constitute the entire agreement between you and Swanirman Academy with respect to your use of our Services, and supersede all prior or contemporaneous communications, proposals, representations, and agreements, whether oral or written, between you and Swanirman Academy regarding the subject matter hereof.

You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of Swanirman Academy. Swanirman Academy may freely assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

The section headings used in these Terms are for convenience of reference only and shall not affect the interpretation or construction of any provision of these Terms.
